Terms of Service

Monet Holdings Group, Inc. is a financial technology company, not a bank. Card issuance and payment services are provided through Rain Cards, Inc. and other third-party providers. USDC is issued by Circle Internet Financial, LLC. Monet accounts are not bank accounts and are not FDIC insured.

These Terms of Service ("Terms") govern your access to and use of the Monet mobile application, website, cards, payment features, digital asset features, referral features, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to Monet's Privacy Policy.

1. Eligibility

You must be at least 18 years old, able to enter a binding agreement, and located in a jurisdiction where Monet supports the Service. We may require identity verification, sanctions screening, fraud review, and additional information before you can use some or all features.

2. Your Account

You are responsible for your account credentials, devices, passcodes, wallet keys, and all activity under your account. You must provide accurate information, keep it updated, and notify us immediately at [email protected] if you suspect unauthorized access.

3. Money Movement and Digital Dollars

Monet lets eligible users receive, hold, send, convert, and spend supported balances. Funds may be held as USDC, a digital dollar issued by Circle and backed 1:1 by cash and short-duration U.S. Treasury reserves. USDC is not a bank deposit and is not insured by the FDIC or any government agency. The value of digital assets can fluctuate, and blockchain transactions may be irreversible.

4. Cards and Spending

The Monet Visa Card is issued by Rain Cards, Inc., pursuant to a license from Visa U.S.A. Inc. Card access, transaction approval, settlement timing, disputes, refunds, and limits may depend on Rain, Visa, merchants, networks, compliance review, and your account standing.

5. Bank Rails and Transfers

Supported local rails may include ACH, wire, Faster Payments, SEPA, Pix, SPEI, Bre-B, or other methods depending on country, provider availability, and regulatory eligibility. Transfer timing, exchange rates, availability, reversibility, and limits may vary. We may delay, reject, reverse, or require extra verification for transfers that present compliance, fraud, security, or operational risk.

6. Fees and Exchange Rates

Monet may show fees, spreads, and estimates before you confirm a transaction. Third parties, banks, networks, merchants, or wallet providers may charge additional fees. Exchange rates can update in real time and may differ from estimates shown before confirmation.

7. Referral Rewards

Referral rewards, if available, are funded by Monet and may change, pause, or end at any time. Rewards are single-level only: you may earn from users you directly refer, not from downstream referrals. Rewards may be withheld or reversed for fraud, abuse, returned transactions, ineligible accounts, or policy violations.

8. Prohibited Uses

You may not use the Service for illegal activity, fraud, sanctions evasion, money laundering, terrorist financing, illegal gambling, trafficking, scams, unauthorized financial services, market manipulation, evasion of limits, abuse of referrals, or activity that violates card network, bank, payment processor, or blockchain provider rules.

9. Compliance, Limits, and Account Restrictions

We may monitor transactions, request information, file reports, place holds, restrict features, freeze an account, close an account, or decline activity when required by law or when we believe it is necessary to protect Monet, users, partners, or the financial system.

10. Third-Party Services

The Service may rely on third parties including banking providers, card issuers, payment networks, identity providers, wallet infrastructure, blockchain networks, analytics providers, and support vendors. Third-party services may have their own terms, privacy policies, outages, limits, fees, and eligibility requirements.

11. No Investment, Tax, or Legal Advice

Monet does not provide investment, tax, legal, accounting, or financial advice. Any information in the Service is for general product use and account management. You are responsible for determining the tax consequences of your activity, including rewards, digital asset transactions, and transfers.

12. Privacy

Our collection and use of personal information is described in the Privacy Policy. By using the Service, you authorize us and our providers to process your information for account setup, identity verification, fraud prevention, compliance, transaction processing, support, analytics, and product operation.

13. Account Closure

You may request account closure by contacting support. We may close or restrict your account for violation of these Terms, risk, inactivity, legal requirements, provider requirements, or discontinued support. Remaining eligible balances may be returned, transferred, or converted subject to law, provider rules, fees, and compliance review.

14. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. If changes are material, we will provide notice through the app, website, email, or another reasonable method. Continued use after changes take effect means you accept the updated Terms.

15. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available." Monet does not guarantee uninterrupted access, error-free operation, provider availability, transaction approval, exchange-rate availability, or blockchain settlement. To the maximum extent allowed by law, Monet is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.

16. Governing Law

These Terms are governed by the laws of the State of Delaware and applicable federal law, without regard to conflict-of-law principles.
